The land market significantly expands the opportunities of large players in the real estate market, because to the usual ones segments agricultural land is added. The moratorium was in effect for a long time, but on July 1, 2021, 20 years after its introduction, it was lifted. Now any natural person has the right to become the owner of land and dispose of it at his discretion. Investors will have even more freedom of action from January 1, 2024, when organizations will be allowed to purchase allotments for economic purposes.
Purchase of agricultural land
Since companies cannot yet bid, there is a wide range of plots of varying fertility on the market. You can find them on electronic trading platforms or special marketplaces. To make a purchase, you need to follow a few simple steps:
- choose a plot of land to your liking;
- check the documentation and verify its authenticity;
- check the site itself to suit your needs;
- if necessary, to conduct topographic survey land allotment;
- to contact a notary to conduct a property purchase transaction;
- if necessary, provide the specialist with a certificate that will confirm source of origin of funds;
- to pay for the purchase (it is important to remember that payment for the purchase of agricultural land is made exclusively without cash);
- certify the contract of sale at a notary;
- register updated data on the state of the property in the State Register of Property Rights.
If you are seriously thinking about purchasing, now is the time to find out about the prices. The price of 1 hectare is clearly regulated. According to Ukrainian legislation, it should not be less than the regulatory monetary assessment. This restriction will be in effect until 2030 inclusive. It is unlikely that the given wording tells you a lot, so let's dwell on it in more detail. This indicator is essentially a capitalized rental income from a specific plot. Its size strongly depends on location, area and fertility. As of January 1, 2022, the following price range for 1 hectare was recorded in the State Geocadastre:
- Zhytomyr region (min) – UAH 21/ha;
- Cherkasy region (max) – UAH 33/ha.
Traditionally, the most fertile and therefore the most expensive lands are located in the central regions of the country.
Sale of agricultural land
The sale of an agricultural plot is not much different from the sale of any other land in Kyiv or region and occurs according to the following algorithm:
- determining a reasonable price. It can be equal to or exceed the regulatory monetary assessment - the fair price is set at the discretion of the owner;
- placing an ad on the electronic auction Prozorro.Sales or on any other resource;
- notarization of the contract of sale and subsequent registration of the plot in the State Register. This is how the transition takes place property rights to the buyer
Don't forget that in the event of a sale, the tenant has the right to first purchase, if there is one. You must obtain a notarized tenant's waiver of this right before considering other nominations. Otherwise, the agreement concluded with third parties may be declared invalid in a court of law.
We advise you to wait until January 1, 2024 to make a profitable purchase for the needs of your company, and for now focus on smaller goals - a plot of land or real estate in the suburbs can be a great investment.
